FAQs – Union Members Addiction Recovery Questions
To begin the process of getting treatment for alcoholism or an addiction, union workers are advised to contact their Union Rep or Employee Assistance Program (EAP).

Both the Americans with Disabilities Act (ADA) and the Family and Medical Leave Act (FMLA) protect addicted individuals from discrimination and help them get the treatment they need without losing the jobs they need to survive.
Once you enter a rehabilitation program, you’re protected by the ADA and cannot be fired for reasons related to your addiction or the treatment process, even if it causes you to miss work. This applies to all state and local government employers and private companies with 15 or more employees.

The Family and Medical Leave Act (FMLA) is a law passed in January of 1993. The FMLA provides eligible employees with up to 12 weeks of unpaid, job-protected leave per year. The employee’s health benefits must also be maintained during these 12 weeks.
According to the United States Department of Labor, if you would like to take FMLA leave to enroll in a drug rehab program (or for any other purpose), you must meet the following requirements:
- You must be employed by a covered employer
- You must have worked for your employer for at least 12 months
- You must have at least 1,250 hours of service for your employer during the 12 month period immediately preceding the leave
- You must work at a location where your employer has at least 50 employees within 75 miles

Every employer’s FMLA policy is different, so your employer may require that you request FMLA leave within a certain time frame before leaving for rehab. Your employer may also request certification from a health care provider or a second or third medical opinion, at their expense, not yours.

An Employee Assistance Program (EAP) is a voluntary, work-based program that offers free and confidential assessments, short-term counseling, referrals, and follow-up services to employees who have personal and/or work-related problems. EAPs address a broad and complex body of issues affecting mental and emotional well-being, such as alcohol and other substance abuse, stress, grief, family problems, and psychological disorders. EAP counselors also work in a consultative role with managers and supervisors to address employee and organizational challenges and needs. Many EAPs are active in helping organizations prevent and cope with workplace violence, trauma, and other emergency response situations.

Functional Alcoholism and High Functioning Addicts
Functional Alcoholism and High Functioning Addicts are a problem in all professions. With functional (high-functioning) alcoholism or drug addiction – the individual continues to go to work every day.
In the beginning, the work performance of a functional alcoholic or addict does not show significant impairment.
In some cases, alcoholism or addiction can continue for years in without much adverse notice in the workplace. However, the addiction cycle with all its negative impacts on physical health – and family relationships – is still operating full force.
This will continue until the addict experiences a DUI, DWI or serious workplace accident.
Or, until the addict finally experiences a major health event and is carried out of the workplace on a stretcher.
Functional Alcoholics and Addicts Rarely Seek Help on Their Own
Functional alcoholics and functional addicts are unlikely to seek help on their own – as they believe they do not have a problem. Relationship partners and children are strongly negatively impacted by the addictive behaviors involved.
If you are in a relationship with a functional alcoholic or addict – it is important to protect yourself and any children involved. Family therapy and stabilization of the entire family is needed for lasting and ongoing recovery.
Interventions are often the best chance for functional alcoholics or addicts to get help.
